DO YOU GET STUCK ON IMPORT PROCEDURES OF USED MACHINES?
According to the recent waves of supply chain from neighbor countries; many businesses tend to import used machines, equipment and technological production lines into Vietnam. Understanding the state regulations helps us avoid many troubles and risks such as: goods arriving at the port but not accepted forcustoms clearance, goods which are on the list of goods prohibited from import into Vietnam must be returned to the export country, goods need the import license,… because all mistakes will cause heavy losses for businesses not only costs but also time and opportunities.
Requirements needed to be allowed to import:
- Purpose of import: to serve the production process, not allow to import for business purposes
- Not in the list of outdated equipment, causing environmental pollution that has been removed from the exporting country
- The equipment age does not exceed 10 years (from manufacture date). For machinery and equipment in some specific fields, the age of equipment is specified in Appendix I issued together with the law 18/2019 / QD-TTg
- Manufacture specification:
– Following criteria of one of G7 countries or South Korea in terms of: safety, energy saving and environmental protection
– Or in accordance with the provisions of national technical regulations (QCVN) on safety, energy saving and environmental protection - For knocked-down assembly machines must to declare details of accompanying parts because customs officers may require synchronous expertise
- For knocked-down assembly machines which are packed into different shipments, it will be required to conduct synchronous valuation
- Machinery with accessories / accessories included in the state quality control list must be registered for state quality inspection separately
For example: air compressor (TT 22/2018 / TT-BLĐTBXH), or check the minimum energy efficiency standard.
The basic import process is as follows:
- Documents and information for declaring declaration:
– Commercial contract
– Commercial invoice
– Packing list
– Bill of lading
– Certificate of origin
– Technical documents/Catalogue - The name of the goods must contain at least the following:
– Vietnamese name
– Brand and model
– Power
– Manufacture date (important) - If the machine is disassembled into may parts, they must be declared as detailed as possible (in case customs officers inspect and require us declare parts separately and charge tax on each item).
- Carry out the transfer for inspection yard (old machinery are always included in the goods list which issubject to inspection), so it is necessary to register to transfer the inspection yard in advance to avoid wasting time. (Apply Cat Lai port).
- When conducting goods inspection, the customs office will carefully check the following information:
– Name, type, label, model, country of manufacture, year of manufacture,…
– Signs of marking, altering, erasing or replacing labels and clearly inscribing the inspection results according to the contents on the “Test Results Form”.
– In case the goods do not show or could not identify the above information, it must be clearly inscribed “The production year, quality, country of manufacture,… cannot be determined after inspection”
– Complete the inspection and submit “Form of bringing the goods to warehouse for preservation”to customs department in order to wait for the valuation result, keep the “Customs handover minutes” slip carefully.
